Who can I gift to?

Do you know the Oprah episode “You get a car! You get a car! Everybody gets a car!”?  Well in your estate plan you can gift to whomever you like and however many people, charities, or entities you like!

Unfortunately, pets miss out on a gift.  But don’t despair, we can make sure your furry, feathered, or scaled loved ones are still looked after in your estate plan.

“Who can I gift to?” is a different question to “Who SHOULD I gift to?”.  Under Queensland law there are three classes of people (spouses, children, and various financial dependants) who are eligible to make a claim against an estate on the basis that they have not been adequately provided for. This is known as a “family provision application”.

We talk about potential claimants as part of the estate planning process. If you are concerned about a potential claim against your estate then you must receive legal advice.
